(Jack Mullen) – The State of Pennsylvania Supreme Court recently ruled that probable cause is all that is required to search an automobile during a traffic stop.  The decision effectively ends the process of requiring a warrant to search a vehicle unless there is probable cause and exigent circumstances.

Further the Pennsylvania High Court’s decision overrides Pennsylvania’s own Declaration of Rights in State Constitution Article I, Section 8.  Article 8 stating 

“The people shall be secure in their persons, houses, papers and possessions from unreasonable searches and seizures, and no warrant to search any place or to seize any person or things shall issue without describing them as nearly as may be, nor without probable cause, supported by oath or affirmation subscribed by the affiant.”[A]

(CNET) – CNET learns the FBI is quietly pushing its plan to force surveillance backdoors on social networks, VoIP, and Web e-mail providers, and that the bureau is asking Internet companies not to oppose a law making those backdoors mandatory.

The FBI is asking Internet companies not to oppose a controversial proposal that would require firms, including Microsoft, Facebook, Yahoo, and Google, to build in backdoors for government surveillance .

In meetings with industry representatives, the White House, and U.S. senators, senior FBI officials argue the dramatic shift in communication from the telephone system to the Internet has made it far more difficult for agents to wiretap Americans suspected of illegal activities, CNET has learned.

The FBI general counsel’s office has drafted a proposed law that the bureau claims is the best solution: requiring that social-networking Web sites and providers of VoIP, instant messaging, and Web e-mail alter their code to ensure their products are wiretap-friendly.

“If you create a service, product, or app that allows a user to communicate, you get the privilege of adding that extra coding,” an industry representative who has reviewed the FBI’s draft legislation told CNET. The requirements apply only if a threshold of a certain number of users is exceeded, according to a second industry representative briefed on it.

The FBI’s proposal would amend a 1994 law, called the Communications Assistance for Law Enforcement Act, or CALEA, that currently applies only to telecommunications providers, not Web companies. The Federal Communications Commission extended CALEA in 2004 to apply to broadband networks.

“Going Dark” timeline

June 2008: FBI Director Robert Mueller and his aides brief Sens. Barbara Mikulski, Richard Shelby, and Ted Stevens on “Going Dark.”

June 2008: FBI Assistant Director Kerry Haynes holds “Going Dark” briefing for Senate appropriations subcommittee and offers a “classified version of this briefing” at Quantico.

April 2009: FBI general counsel’s office reports that the bureau’s Data Interception Technology Unit has “compiled a list of FISA dockets… that the FBI has been unable to fully implement.” That’s a reference to telecom companies that are already covered by the FCC’s expansion of CALEA.

May 2009: FBI’s internal Wikipedia-knockoff Bureaupedia entry for “National Lawful Intercept Strategy” includes section on “modernize lawful intercept laws.”

May 2009: FBI e-mail boasts that the bureau’s plan has “gotten attention” from industry, but “we need to strengthen the business case on this.”

June 2009: FBI’s Office of Congressional Affairs prepares Going Dark briefing for closed-door session of Senate Appropriations subcommittee.

July 2010: FBI e-mail says the “Going Dark Working Group (GDWG) continues to ask for examples from Cvber investigations where investigators have had problems” because of new technologies.

September 2010: FBI staff operations specialist in its Counterterrorism Division sends e-mail on difficulties in “obtaining information from Internet Service Providers and social-networking sites.”

FBI Director Robert Mueller is not asking companies to support the bureau’s CALEA expansion, but instead is “asking what can go in it to minimize impacts,” one participant in the discussions says. That included a scheduled trip this month to the West Coast — which was subsequently postponed — to meet with Internet companies’ CEOs and top lawyers.

A further expansion of CALEA is unlikely to be applauded by tech companies, their customers, or privacy groups. Apple (which distributes iChat and FaceTime) is currently lobbying on the topic, according to disclosure documents filed with Congress two weeks ago. Microsoft (which owns Skype and Hotmail) says its lobbyists are following the topic because it’s “an area of ongoing interest to us.” Google, Yahoo, and Facebook declined to comment.

In February 2011, CNET was the first to report that then-FBI general counsel Valerie Caproni was planning to warn Congress of what the bureau calls its “Going Dark” problem, meaning that its surveillance capabilities may diminish as technology advances. Caproni singled out “Web-based e-mail, social-networking sites, and peer-to-peer communications” as problems that have left the FBI “increasingly unable” to conduct the same kind of wiretapping it could in the past.

In addition to the FBI’s legislative proposal, there are indications that the Federal Communications Commission is considering reinterpreting CALEA to demand that products that allow video or voice chat over the Internet — from Skype to Google Hangouts to Xbox Live — include surveillance backdoors to help the FBI with its “Going Dark” program. CALEA applies to technologies that are a “substantial replacement” for the telephone system.

“We have noticed a massive uptick in the amount of FCC CALEA inquiries and enforcement proceedings within the last year, most of which are intended to address ‘Going Dark’ issues,” says Christopher Canter, lead compliance counsel at the Marashlian and Donahue law firm, which specializes in CALEA. “This generally means that the FCC is laying the groundwork for regulatory action.”

16APR2014: FBI Visiting Gun Shops to Investigate “People talking about Big Government”


(Activist Post) – In keeping with the tradition of the FBI’s position on gun rights, it appears the Bureau is working overdrive to monitor and harass gun owners and the gun shops that sell to them.

While government surveillance of gun purchases and gun owners is nothing new, a recent visit by an FBI Counterterrorism agent to a Columbia, South Carolina gun shop has only reinforced the knowledge that the U.S. government is growing more and more concerned by the prospect of a well-armed populace – particularly one that prefers to live without constant government interference in their personal lives.

While the narrative surrounding “counterterrorism” operations used to eviscerate civil liberties after 9/11was initially based upon the threat of Muslim fundamentalists, that narrative has clearly shifted to a focus on gun owning, law-abiding American citizens – both those who are politically active and those who are blissfully ignorant of current events.

“Never in a million years would I have thought this guy was a fed,” said the witness. “He was in a completely normal vehicle. Regular clothes. Everything. I would have thought this guy was just some downhome country boy.”

After showing proper identification, the agent told the shop owners that he was tasked with all the gun shops in the general area and that he was charged with investigating “suspicious purchases” in accordance with counterterrorism operations.

The suspicious purchases he mentioned, however, were completely normal transactions. This included, paying with cash, purchasing long guns, and other similarly innocuous behavior.

However, what surprised the owners the most was his statement regarding what he was most interested in tracking.
For many, this shift of focus has been quite the surprise. Thus, when the Columbia, South Carolina gun shop in question was approached by an FBI counterterrorism agent on Monday, April 14, the individuals who spoke with him were somewhat alarmed to realize that the agent’s concern was not fundamentalist Muslims but Americans who promote small government.

According to the witness, the agent stated, “If you see some Middle Eastern guy come in. You don’t have to be so worried about that. What we’re really looking for are people talking about being sovereign such as sovereign citizens or people talking about Big Government.”

The agent also mentioned that he had a spreadsheet of all the gun shops in the area.

After this brief chat, the agent left a flyer with the shop that listed some of the more generic and normal behaviors which they were expected to view as suspicious.

Some of these trigger behaviors are:

  • Payment in cash or someone else’s credit card.
  • Reluctant or unwilling to produce valid I.D.
  • Large purchases or unusual inquiries into buying in bulk
  • Lack of knowledge involved in firearms or product usage
  • Hints at illegal or misuse of explosives
  • New or unknown customers
  • Nervousness or evasiveness

In the end, while the visit to a local gun shop by an FBI Counterterrorism agent is no surprise, it should serve as a stark reminder that the U.S. government is vastly concerned about a well-armed populace. Gun rights have been gradually eroded in the United States for decades but the assault on gun rights has been ratcheted up to a new level by the Obama administration.

Still, those expecting a public declaration of total gun illegality and martial law confiscation will be wringing their hands in anticipation for a very long time. Of course, while they wring their hands and anticipate the declaration of outright war against gun owners, their guns are being slowly stripped from their hands in an incremental fashion. Slight rule changes and isolated confiscations will continue to take place over time until the public has been properly acclimated to them as a fact of life, at which point the public’s line in the sand will be moved slightly forward once more. Again, the line will be crossed, but only slightly. Eventually, Americans will wake up to find themselves completely disarmed and neutered in a land in which they once believed they were free. At that point, with a completely defenseless population, the thin veneer of freedom will be lifted.

It is time for gun owners and gun rights activists to go on the political offensive. In 2014, it is no longer a legitimate mode of activism to be content to defend your already attenuated freedoms. It is time to make demands. It is time to throw compromise out the window.

According to an individual who was present during the visit (this person will remain anonymous for obvious reasons), the agent pulled up in a regular vehicle in plain clothes and took a look around the shop as if he were considering a purchase before approaching the staff and announcing that he was with the FBI Counterterrorism unit.

Editorial comment: As we have seen in the past few years, more police and sheriff departments are taking hand outs from the government to wreck America as the police departments and Sheriffs across this nation are taking handouts for a so-called  ‘war from within’ concept to go along with their para-military training…

(TheNewsDispatch) – MICHIGAN CITY — The Michigan City Police Department recently added a new piece of equipment to its fleet – a Mine Resistant Ambush Protected (MRAP) vehicle.

Valued at $793,000, the MRAP was donated to the MCPD from the United States military through the 1033 Federal Surplus Program, which has distributed hundreds of surplus military vehicles to law enforcement agencies across the country.

Receiving this vehicle at no cost to the city, the department was only responsible for retrieving the MRAP from Sealy, Texas. Six spare tires for the MRAP, valued at $5,000 each, were included in the contribution from the U.S. military.

As for the vehicle maintenance and upkeep, MCPD Chief of Services Royce Williams said it is no different from the other city-owned vehicles, indicating it only requires basic check-ups.

“The body of the MRAP was built in 2012, but the engine, chassis and tires are all brand new so there should be very minimal upkeep for this vehicle,” he said.

Built to withstand heavy gunfire and blasts from explosive devices, the bullet-proof and fire-proof vehicle may seem over-the-top for a city such as Michigan City. But the MCPD is happy to have access to such a heavy-duty piece of equipment.

“Our community should be grateful to have a tool such as the MRAP at their disposal if needed,” Williams said. “If this piece of tactical equipment saves just one life, it will have been worth it, and that’s the bottom line.”

The MCPD will utilize the MRAP in several capacities including training, incident command, active shooting events and high risk warrant services, Williams said.

There are several scenarios in which the police department could justify the use of the MRAP, according to Williams. For example, encountering a barricaded or suicidal person with deadly weapons, transporting a negotiator closer to the scene during a hostage stand-off, or serving warrants to suspects known to have weapons and the criminal capacity to use them, he said.

Williams also said the vehicle can be deployed in severe weather or used as incident command during volatile situations. The MRAP also can be used to extract innocent civilians from active shooter situations at schools or businesses.

With two seats in the cab and eight additional seats in the rear compartment, the MRAP can comfortably seat 10 adults. However, the vehicle can hold approximately 20 children if needed in an emergency situation, Williams said.

Considering the miles of sandy lakefront and dunes within Michigan City, the MRAP also could serve another potentially life-saving purpose. The vehicle’s six tires, each measuring approximately three-and-a-half feet in diameter, have the capability of deflating in seconds, allowing the MRAP to easily travel over sand.

This is done without damaging the tires as they can be re-inflated in approximately 15 minutes.

Although several officers on the Michigan City Police Department have experience with military vehicles, only one officer on the force is currently certified to drive the MRAP – Officer Mike Petrie.

He has been deployed to Baghdad, Iraq twice while serving more than four years with the United States Army. Petrie served as a mechanic during that time, experiencing a variety of military-issue vehicles.

“All military vehicles are pretty much the same as far as the internal cockpit,” he said, adding there are a variety of different MRAP models, but he is familiar with the model received by the department.

Although he is excited to have the MRAP in Michigan City, Petrie said he hopes the city is never faced with a situation that would require using it.

As a certified MRAP driver, Petrie will be involved in the process to get some of his fellow MCPD officers qualified to operate the force’s new vehicle. The department plans to construct a training course, based on the program used by the U.S. Army, to train two officers per shift to drive the MRAP.

Petrie said what makes driving the 40,000-pound vehicle so difficult are the number of blind spots. As a bullet-proof, mine resistant vehicle, windows on the MRAP are at a minimum, making it difficult to see the surrounding environment.

The MRAP stands more than 11 feet high and can travel up to 65 mph. One feature of the MRAP, which is necessary for a vehicle so tall, is a gauge indicating whether or not the vehicle is tilting – helping the driver prevent it from tipping over while traveling.

Having the MRAP for only two weeks so far, the department plans to customize the vehicle in the future. Plans include stripping the inside of everything military-specific that is not needed by the police. Lights and a radio will be added to the MRAP in addition to a new paint job.
